Security - NJ TRANSIT has implemented a number of security features throughout the NJ TRANSIT site to prevent the unauthorized release of or access to personal information. For example, database information is kept separate from live servers and is firewall protected. Please be advised, however, that although NJ TRANSIT has endeavored to create a secure and reliable site for you, the confidentiality of any communication or material transmitted to or from NJ TRANSIT via the NJ TRANSIT site or e - mail cannot be guaranteed. When disclosing any personal information, you should remain mindful of the fact that it is potentially accessible to the public, and consequently, can be collected and used by others without your consent. 1. ACCEPTANCE OF TERMS
2. DESCRIPTION OF SERVICE
MY TRANSIT currently provides users with access to a wide variety of on - line resources, including, various tools, to plan transportation via NJ TRANSIT including itinerary planning, schedule and fare information, and customer alerts. You understand and agree that the service is provided "AS - IS" and that MY TRANSIT assumes no responsibility for the timeliness, deletion, mis - delivery or failure to store any user communications or personalization settings. Further, you understand that registering for MY TRANSIT alerts does not implicitly or explicitly guarantee that an alert will be generated for every delay within the parameters following or that MY TRANSIT registration and alerts are not indicators or guarantees of performance by NJ TRANSIT trains, buses, or light rail vehicles.
MY TRANSIT alerts will be delivered to registrants according to the following criteria: (a) delays in service of 15 minutes or more; (b) cancellations in service; (c) closures of facilities affecting access to service. Alerts will be generated only during morning (5:30 a.m. - 9:30 a.m.) and evening (3:00 p.m. - 7:30 p.m.) peak periods on weekdays, Monday through Friday. NJ TRANSIT reserves the right to issue alerts outside of these times during service disruptions and outages at the discretion of management. However, issuing such alerts is not intended and should not be construed as a change in terms or service. Alerts will be generated for all NJ TRANSIT rail lines, bus lines serving New York City and Philadelphia, and light rail lines. Alerts will be generated based on the parameters of your trip and registration. To avoid receiving large numbers of alerts (especially when access charges are based on volume) register for alerts specific to train numbers, bus routes, and light rail systems utilized for your daily commute.
MY TRANSIT alerts will be composed to use a minimum of characters (maximum of 200 characters) to enable viewing on the widest range of wireless devices and widest access of wireless carriers. To achieve this, MY TRANSIT alerts will utilize abbreviations in referring to rail, bus, and light rail service. For example, NJCL for "North Jersey Coast Line". Abbreviations will be displayed for review during the MY TRANSIT registration or account management processes.
In order to access the NJ TRANSIT web site, you must obtain access to the World Wide Web, either directly or through devices that access web - based content, and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device. In order to receive MY TRANSIT alerts you must have access to an email account, or a wireless device (pager, cellular telephone, PDA, etc.) that can receive alphanumeric messages through an email address and access. Failure to maintain an active email or wireless service account, or failures by your ISP or wireless carrier so that you are unable to receive transit alerts are the responsibility of the registrant. Alert messages will be composed to be 200 characters or less. If your wireless device lacks 200 - character capability or your wireless service account has restrictions and limitations of less than 200 characters, you will receive truncated messages.
3. YOUR REGISTRATION OBLIGATIONS
In consideration of your use of MY TRANSIT, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the MY TRANSIT registration form and (b) maintain and promptly update the data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or if MY TRANSIT has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, MY TRANSIT has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). Failure to provide or maintain accurate and complete data that results in an inability to receive transit alerts if the responsibility of the registrant. You are solely responsible for the information pertaining to your account and itinerary and should print or otherwise maintain the specific information of your MY TRANSIT account in the event computer failure that causes a loss of data on your part or on servers maintained by NJ TRANSIT.
4. MEMBER ACCOUNT, PASSWORD AND SECURITY
You will receive a password and account designation during the registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify MY TRANSIT of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. MY TRANSIT cannot and will not be liable for any loss or damage arising from your failure to comply with this.
5. NO RESALE OF SERVICE
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the service, use of the service, or access to the service.
6. YOUR RIGHT TO PRIVACY
NJ TRANSIT will not use or share information gathered here except to contact you with information about this organization, transit services, or transportation. NJ TRANSIT may provide information to outside entities who we engage to perform email/alert delivery services on our behalf. We do not rent or sell information to other entities.
7. MODIFICATIONS TO SERVICE
MY TRANSIT reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. You agree that MY TRANSIT shall not be liable to you or to any third party for any modification, suspension or discontinuance of the service.
You agree that MY TRANSIT, in its sole discretion, may terminate your password, account (or any part thereof) or use of the service, and remove and discard any content within the service, for any reason, including, without limitation, for lack of use or if MY TRANSIT believes that you have violated or acted inconsistently with the letter or spirit of the TOS. MY TRANSIT may also in its sole discretion and at any time discontinue providing the service, or any part thereof, with or without notice. You agree that any termination of your access to the service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that MY TRANSIT may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the service. Further, you agree that MY TRANSIT shall not be liable to you or any third - party for any termination of your access to the service.
NJ TRANSIT RSS Feed Terms and Conditions
Individuals and web developers are free to access NJ TRANSIT's "Travel Alert" RSS feeds to view in RSS readers or display on their own websites with the following restrictions:
- Anyone accessing these feeds will hold NJ TRANSIT harmless in the event of NJ TRANSIT's RSS feeds being temporarily unavailable, permanently discontinued, or inaccurate for technical reasons or data - entry error. Please see the My Transit Travel Alerts disclaimer for details.
- NJ TRANSIT will not provide technical support for users to install and configure RSS readers of web scripts to access NJ TRANSIT's RSS feeds.
- Anyone displaying NJ TRANSIT RSS feeds on a website shall not imply endorsement by NJ TRANSIT of any product, service or opinion promoted on that site.
- NJ TRANSIT is not responsible for the content of external sites.
NJ TRANSIT Quik - Tik® Online Ticket Sales Agreement and Terms

Before you can join Quik - Tik ("the Service"), you must read and agree to the Subscriber Agreement and conditions set forth below. By joining this Service, you agree to be bound by the terms of this Agreement in their entirety. You must click the "I AGREE" button at the end of the Agreement. If you do not agree to be bound by the terms of the Agreement, you should click "I DISAGREE". If you click "I DISAGREE", you will not be able to proceed with the NJ TRANSIT Quik - Tik registration process or become a Quik - Tik subscriber.
1. QUIK - TIK AUTOPAY: TERMS AND CONDITIONS FOR CREDIT CARD / PRE - AUTHORIZED DEBIT
I hereby authorize NJ TRANSIT to enroll me in the Quik - Tik AutoPay program. I understand the terms and conditions described below. I understand that this charge is a recurring charge during the months that I elect to receive monthly passes via mail from NJ TRANSIT. I authorize and instruct NJ TRANSIT to charge the amount of my monthly NJ TRANSIT invoice to my designated credit card/charge card or bank/checking account. The amount to be charged, set forth on my invoice, shall be sent by NJ TRANSIT to the credit or check card company or bank, which I identify, on the due date listed on the invoice. I understand my payment amount may change because of changes in fees, fares, stations and service or my ticket purchase adjustments. I understand that if my payment due date is on a weekend or holiday, my account will be charged on the preceding business day. I understand and agree that NJ TRANSIT is not liable in any way for erroneous Quik - Tik bills or incorrect charges to my Quik - Tik account and/or credit card accounts and/or debits to my checking account, and that should an error in the bill occur, NJ TRANSIT's sole responsibility is to correct it, when and if it receives written notice of the error, with proper documentation, from me. I understand my financial institution and NJ TRANSIT reserve the right, upon written notification to me, to terminate this payment option and/or my participation in Quik - Tik and/or the AutoPay Program. My participation is subject to the approval of NJ TRANSIT and of the participating financial institution. I am responsible for any charges imposed by my bank or credit card Company for exceeding my account limits or overdrawing my account.
2. CUSTOMER INFORMATION
In consideration of my use of Quik - Tik, I agree to: (a) provide true, accurate, current and complete information about myself as prompted by the Quik - Tik registration form and (b) maintain and promptly update the data to keep it true, accurate, current, and complete. If I provide any information that is untrue, inaccurate, not current, or incomplete, or if NJ TRANSIT has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, NJ TRANSIT retains the right to suspend or terminate my Quik - Tik account and refuse any and all current or future use of the Service (or any portion thereof). Providing and maintaining accurate and complete data is my responsibility. I am solely responsible for the information pertaining to my account and email address and should print or otherwise maintain the specific information of my Quik - Tik account in the event computer failure causes a loss of data on my part or on servers maintained by NJ TRANSIT.
I will receive a password and account number during the registration process. I am responsible for maintaining the confidentiality of the password and account, and am fully responsible for all activities that occur under my password or account. I agree to (a) immediately notify NJ TRANSIT of any unauthorized use of my password or account or any other breach of security, and (b) ensure that I exit from my account at the end of each session. NJ TRANSIT is not liable for any loss or damage arising from my failure to comply.
If any breach of security, theft or loss of password, or unauthorized disclosure of password occurs, I must immediately notify NJ TRANSIT of said security breach. I will remain liable for unauthorized use of Service until I notify NJ TRANSIT of the security breach by email or telephone by calling the contacts set forth in section 10 of this Agreement.
3. PROCESSING FEE
Effective with the August 2009 mailing of September 2009 monthly passes, a $3 processing fee will be applied each month to all ticket - by - mail (Quik - Tik) transactions. This fee is applied to offset the cost of processing ticket - by - mail transactions and is non - refundable. I understand that this processing fee is subject to change at any time without notice.
I agree that NJ TRANSIT in its sole discretion may terminate my password, account (or any part thereof), or use of the Service, and remove and discard any content within the Service, for any reason, including, without limitation, if the account is unused for twelve (12) consecutive months or if NJ TRANSIT believes that I have violated the terms of this Agreement.
I agree that any termination of my access to the Service under any provision of this Agreement may be effected without prior notice, and acknowledge and agree that NJ TRANSIT may deactivate or delete my account and all related information and files in my account and/or bar any further access to such files or the Service. Further, I agree that NJ TRANSIT shall not be liable to me or any third - party for any termination of this Agreement or my access to the Service.
NJ TRANSIT may also in its sole discretion and at any time discontinue providing the Service, or any part thereof and will notify me prior to such termination.
At any time, and for any reason, I may cancel my subscription to the Service by electronic or conventional mail, or by telephone at the address and telephone numbers set forth in section 10 of this Agreement. Accounts can be cancelled online at the bottom of the Account Summary screen.
I understand that if at anytime I decide to cancel the Service, NJ TRANSIT must receive notification at least 7 days prior to the payment due date to prevent a charge for that month's ticket.
I am liable for charges incurred by me until the date of cancellation of Service.
If I request cancellation or request a refund from my bank or card issuer due to unauthorized or fraudulent use, NJ TRANSIT can at its discretion, to prevent further unauthorized use, block my account or card from use on njtransit.com.
6. CREDITS/REFUNDS/RETURNED PASSES
Should a pass be returned to NJ TRANSIT, any applicable credits will be applied to my Quik - Tik account. Refunds to my billing credit or check card will only be issued on request at the cancellation of my Quik - Tik account.

Full: For full credit, returns must be postmarked before the first day of the month for which the pass is valid.
Partial: For returns postmarked the first day of the month of validity or later, partial credit will be issued to my Quik - Tik account based on the value of two full one - way fares deducted from the purchase price for each business day from the start of the validity period to the postmark date of the refund request.

7. SUPPLEMENTARY TERMS AND CONDITIONS
These Terms and Conditions are integrated to and supplement the terms and conditions for use of the website, www.njtransit.com or MyTransit.
If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid or enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
Notices by NJ TRANSIT to subscribers may be given by means of electronic messages through the site, by a general posting on the site, or by conventional mail.
Notices by subscribers may be given by electronic messages, conventional mail or telephone unless otherwise specified in the Agreement. All questions, complaints, or notices regarding Quik - Tik must be directed here. All cancellations of Service must be directed to Quik - Tik as shown in section 10 of this Agreement.

NJ TRANSIT grants you a non - exclusive, non - transferable, limited right and license to install and use the App for your non - commercial personal use on an authorized mobile device solely as set forth in this license providing that you comply fully with these terms and conditions. Your acquired rights are granted subject to your compliance with this license. Any commercial use is prohibited. You are expressly prohibited from sub - licensing, renting, leasing, transferring or otherwise distributing the App or rights to use the App. The term of your license shall commence on the date that you install or otherwise use the App, and shall end on the earlier of the date that you dispose of the App; or termination of this license. You shall not interfere or attempt to interfere with the operation or use by others in any way, nor re - engineer or reverse engineer the App.
All rights expressly and not expressly granted are reserved by NJ TRANSIT. All information, products, software, services and other materials, hereinafter "the Materials," provided as part or accessed via this App are the property and copyrighted work of NJ TRANSIT. Except as stated in these legal terms for personal travel information, none of the Materials may be copied, downloaded, reproduced, altered, distributed, republished, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying or recording. No part of this App, including, but not limited to, any logo, graphic, word or design mark, sound or image, may be reproduced or retransmitted in any way, or by any means.
Use of the NJ TRANSIT Mobile App will require your device(s) to have access or connection via mobile network or Internet (fees may apply), and may require obtaining updates or upgrades from time to time. Because use of the NJ TRANSIT Mobile App involves hardware, software and Internet access, your ability to use the NJ TRANSIT Mobile App may be affected by the performance of these factors. By accepting these terms and conditions, you acknowledge and agree that complying with such system requirements, which may be changed from time to time, are your responsibility and that your use of any third - party services are subject to the terms and conditions of use established by the respective third - party service providers.
The NJ TRANSIT Mobile App may automatically download and install updates from time to time. NJ TRANSIT may issue updates to the App, in which case you may not be able to continue use of the mobile App installed on your mobile device without downloading the update. You agree to such downloading and installation of updates as part of your use of the App.
NJ TRANSIT does not guarantee the accuracy or completeness of any information obtained through this App including such features as, but not limited to, service, schedule, fare information, arrival/departure times or routes. NJ TRANSIT is not responsible if the App does not perform as desired. NJ TRANSIT is not financially responsible for any loss or reimbursement as a result of your use of the transit information contained within the App. Service to the App could be interrupted or disrupted due to atmospheric conditions, inaccurate satellite data, and other factors associated with use of satellites. You agree that your use of the App shall be at your sole risk.
You must provide at your own expense the equipment, Internet connections or devices and/or service plans to access and use this App. NJ TRANSIT does not guarantee that this App can be accessed on all devices or wireless service plans. NJ TRANSIT does not guarantee that this App is available in all geographic locations. You acknowledge that when you use this App, your wireless carrier may charge you fees for data, messaging and/or other wireless access. Check with your carrier to see if there are any such fees that apply to you. You are solely responsible for any costs you incur to access this app from your device.
This license is effective until terminated. Your rights under this license will terminate immediately and automatically without any notice from NJ TRANSIT if you fail to comply with any of the terms and conditions of this license.
To the fullest extent permissible under applicable law, the App is provided to you "as is," with all faults, without warranty of any kind, without performance assurances or guarantees of any kind, and your use is at your sole risk. The entire risk of satisfactory quality and performance resides with you. NJ TRANSIT for purposes of this section does not make, and hereby disclaims, any and all express, implied or statutory warranties, including implied warranties of condition, uninterrupted use, merchantability, satisfactory quality, fitness for a particular purpose, non - infringement of third - party rights, and warranties (if any) arising from a course of dealing, usage, or trade custom. NJ TRANSIT does not warrant against interference with your enjoyment of the App; that the App will meet your requirements; that operation of the App will be uninterrupted or error - free; that the App will interoperate or be compatible with any other App; that any errors in the App will be corrected; or that the App will be available for reinstalls to the same or multiple devices. No oral or written advice provided by NJ TRANSIT or any authorized representative shall create a warranty.
To the fullest extent permissible by applicable law, in no event shall NJ TRANSIT be liable to you for any personal injury, property damage, lost profits, cost of substitute goods or services, loss of data, loss of goodwill, work stoppage, computer failure or malfunction or any other form of direct or indirect, special, incidental, consequential or punitive damages from any causes of action arising out of or related to this license or the App, whether arising in tort (including negligence), contract, strict liability or otherwise, whether or not NJ TRANSIT has been advised of the possibility of such damage.
You agree that the provisions in this license that limit liability are essential terms of this license.
If any provision of this license is illegal or unenforceable under applicable law, the remainder of the provision shall be amended to achieve as closely as possible the effect of the original term and all other provisions of this license shall continue in full force and effect.
You agree that a breach of this license will cause irreparable injury to NJ TRANSIT for which monetary damages would not be an adequate remedy and NJ TRANSIT shall be entitled to seek equitable relief in addition to any remedies it may have hereunder or at law without a bond, other security or proof of damages.
The laws of the State of New Jersey, excluding its conflicts of law rules, govern this license and your use of the App, and you expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to this license and/or your use of the App shall be the State Courts in New Jersey and you expressly consent to the exercise of personal jurisdiction of such Courts.
This license constitutes the entire agreement between you and NJ TRANSIT with respect to the App and supersedes all prior or contemporaneous understandings regarding such subject matter. No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of any other right hereunder. In the event of a conflict between this license and any applicable purchase or other terms, the terms of this license shall govern.
"Mobile phone" used within these terms relates to any mobile device that is able to install the App and display the mobile ticket using the devices' data capability.
Security - The security of your mobile phone is your responsibility. However if your mobile phone is lost/stolen/replaced, you can sign in to your account (on your new phone) with your User ID (email) and password. If you have active or non - active tickets, and do not see them, please delete and reinstall the app. If your tickets are still not shown please contact NJ TRANSIT at 973 - 275 - 5555 for assistance importing your tickets to your new mobile phone.
Purchasing Tickets - By purchasing a mobile ticket you agree to activate the ticket prior to boarding the vehicle, cooperate fully with the train conductor, driver or ticket inspector, and display your mobile phone and any of the ticket details for inspection. It is your responsibility to ensure that the mobile phone is sufficiently charged and functional to clearly display the ticket as required for the duration of your journey. If you are unable to display your mobile ticket, you will be required to purchase a new fare (surcharge may apply).
Credit Card Authorizations - You authorize and instruct NJ TRANSIT to charge the amount of your purchase to a designated credit card/charge card or debit card. You understand and agree that NJ TRANSIT is not liable in any way for incorrect charges to your credit card account(s), and that should an error occur, NJ TRANSIT's sole responsibility is to correct it, when and if NJ TRANSIT receives written notice of the error, with proper documentation, from you. You are responsible for any charges imposed by your bank or credit card company for exceeding your account limits or overdrawing your account.
System Maintenance - During system maintenance and upgrades, you may be unable to purchase/activate tickets via the App. Every effort will be made to keep service disruptions to a minimum.
Collection and Use of Information - NJ TRANSIT may collect personal information about you (such as your name, address, mobile phone number and email address) through use of the App or App features.
